Bloomingburg resident with drugs at Eyman Park sentenced


A Bloomingburg resident admitted to using drugs at Eyman Park and was sentenced Monday to treatment and probation.

Joshua E. Queen, 36, was arrested Sept. 18, 2016 after someone called the Washington Court House Police Department with a complaint of drug activity at the park.

Upon arriving, police officers saw Queen leave the area at a high rate of speed but not before the police were able to run the registration for the tags. The tags, as it turned out, were for a 1999 grey Chevrolet but were attached to a cream-colored Ford Escort. The officers pursued the Escort a short distance and made a traffic stop.

After talking with Queen, the officers found that he did not possess a valid driver’s license. A passenger in the front seat of the car kept bending forward “as if he was reaching for something,” according to reports.

The officer asked the passenger, Paul W. Smith, 30, to get out of the vehicle.

A K-9 officer was called to the scene and allegedly a container with several hypodermic needles and a crack pipe were located on the floorboard of the car and two hypodermic needles and a burnt spoon on the driver’s side.

Also, allegedly, a loaded hypodermic needle with a brown liquid was located on the passenger side where Harris was seated, with another burnt spoon.

The substance in the hypodermic needle was tested by BCI and the test results in the case file indicate that the substance tested positive for heroin.

Queen plead guilty Monday to possession of heroin, a felony of the fifth degree. He was ordered to two years of community control to be supervised by the Fayette County Adult Probation Department. He was additionally ordered to complete treatment at Fayette Recovery, including any aftercare. Violation of the sentencing may result in a one-year prison sentence.

Harris was charged with possession of heroin, a felony of the fifth degree, and is expected to appear for a final pre-trial May 30.
