Man sent to prison for having sex with 15-year-old

Gumersindo Lopez, who lived with a woman and nine of her children at a Bloomingburg residence, was sentenced to nine years in prison this week on four counts of sexual battery of a 15-year-old girl.

In late April, a neighbor of the family’s home, located at 71 Biddle Blvd. Lot 46, told Fayette County Sheriff’s Office (FCSO) detectives that one of the children claimed that Lopez, 30, had been sexually molesting her, according to reports. This 11-year-old girl had been staying with the neighbor at the time she made the claim.

It was also divulged that Lopez had sex with her 15-year-old sibling and that they had a child together, according to the FCSO. Detectives spoke with the family and found that the 15-year-old had a child who was not yet 1-year-old.

The 15-year-old reportedly admitted to the FCSO that she had been sexually active with Lopez from November 2018 through January 2019. The girl gave birth in September of 2019, according to the FCSO. The girl told detectives that she had also been sexually active with another man and wasn’t sure of the father of the baby.

When detectives questioned Lopez, he originally denied the accusations but later admitted to them, according to the FCSO. He was arrested on allegations of rape of the 11-year-old, as well as unlawful sexual conduct and sexual battery of the 15-year-old.

Lopez was indicted by a Fayette County grand jury on two counts of first-degree felony rape for the alleged sexual assault of the 11-year-old. He was indicted on four counts of sexual battery and four counts of unlawful sexual conduct with a minor in the case of the 15-year-old.

DNA evidence was obtained and proved that Lopez was the father of the 15-year-old’s child. No physical evidence was discovered to prove the sexual assault of the 11-year-old, according to the FCSO.

As part of a plea agreement, Lopez pleaded guilty to four counts of sexual battery, each a felony of the third degree. The rape and unlawful sexual conduct counts were dropped by the Fayette County Prosecutor’s Office as part of the agreement.

On Monday, Fayette County Common Pleas Court Judge Steven Beathard sentenced Lopez to nine years in prison. He was also designated as a Tier III sex offender — a designation that goes to the most severe offenders. Tier III offenders must register their address with authorities for life and must verify their address every 90 days.
