Two men reported as suspicious have been charged after allegedly being in possession of drugs and a stolen pistol.
Frank A. Davis, Jr. was convicted of aggravated trafficking in drugs Monday and was sentenced to prison. Davis, 47, plead guilty to aggravated trafficking in drugs, a third degree felony, trafficking in heroin, a fourth degree felony, and trafficking in cocaine, a fourth degree felony.
Davis was ordered to serve a one-year prison sentence, to run concurrently with a second case that convicted him of heroin possession, a felony of the fifth degree. In that case, police were called after Davis was found unconscious in a vehicle on Eyman Park Drive in November. A small baggie with an off-white powder tested positive for heroin.
Six months later the trafficking case was filed when Davis and another Washington Court House man were reported by a passerby to police as acting suspicious.
The two men were in a vehicle on Washington Square. A Washington Court House police officer responded to the call, and upon approaching the vehicle, allegedly observed the passenger attempting to hide a glass meth pipe. The officer asked the passenger, identified as Justin M. Wilson, 22, to get out of the vehicle. Allegedly a .22 caliber pistol was in Wilson’s pocket loaded with five rounds of ammunition, according to reports.
The driver, identified as Davis, was asked to exit the vehicle. Davis gave permission for officers to search the vehicle. The police report said that 98 small plastic baggies, one glass pipe, one glass tube, two digital scales with drug residue, and hypodermic needles were located in the search. Allegedly residue and drug materials inside the drug items tested positive for heroin, crack, marijuana and cocaine.
Davis and Wilson allegedly denied owning any of the items. They were both arrested and transported to the Fayette County Jail and charged.
Davis received 33 days of jail time credit for days already served in the Fayette County Jail on the charges. He was additionally ordered to pay a mandatory $7,500 fine on the aggravated trafficking in drugs charge. The fine was suspended, as Davis was found to be indigent and unable to pay costs or fines in the matter.
Following sentencing, Davis was transported from the court by the Fayette County Sheriff’s Office to the Correctional Reception Center in Orient to commence his prison sentence.
Wilson is still facing charges in the Fayette County Court of Common Pleas, including aggravated trafficking in drugs, a third degree felony, and improperly handling a firearm in a motor vehicle, a fourth degree felony.
Wilson was later arraigned on a fourth degree felony for receiving stolen property because the pistol Wilson was allegedly carrying in his pocket had been reported stolen out of a truck in Washington C.H.
Wilson has entered a not guilty plea on all charges and is expected to appear in court again July 10 for a formal pretrial conference.
